📄 What is a nota simple?
Think of it as the “health report” of a property. It is an informative document issued by the Land Registry that summarises who owns a property and what charges or restrictions affect it.
Why is it so important when buying or selling? 🤔
- 🔎 You can see who the property actually belongs to and whether any third parties have rights over it.
- 💶 You can adjust the price according to anything that may affect its real value: mortgages, liens, easements, usufructs, etc.
✅ What is it for and what information does it contain?
With a nota simple, you can:
Check ownership 🔐: make sure there are no registry issues and avoid surprises when it comes time to sign.
Speed up negotiations ⚡: if one party already has it, the other doesn’t need to request it, making the process faster.
Verify the property details 📐: usable and built-up area, location, boundaries... Objective information with no hidden surprises.
Apply for a mortgage 🏦: banks usually require one before assessing your loan.
Here’s what you’ll find inside:
- 🏠 Property description: location, address, areas, characteristics and cadastral reference.
- 👤 Current ownership: who the owner or owners are.
- 🚫 Limitations, prohibitions or restrictions affecting the owner’s rights.
- 💳 Charges: for example, an existing mortgage.
- 📋 Special legal status: for example, whether it is officially protected housing (VPO).
💻 How do you request it?
It’s easier than it sounds! You simply request it from the Land Registry, and the best part is that you can do it online, without leaving home 🛋️. You will normally receive it within a maximum of two hours ⏱️.
💰 How much does it cost?
The price is standardised and depends on how you request it. For example, through the 🏛️ College of Registrars of Spain, the fee would be €9.02 + VAT.
💡 Fees can change, so make sure you confirm the current price when you request it.
🤷 Who has to provide it when buying or selling a property?
There is no legal obligation here: either party can request it. That said, in practice:
- 🙋 If you’re selling: ideally, provide it along with the rest of the documentation. It conveys confidence and transparency to potential buyers.
- 🛒 If you’re buying: it is normal to request your own so you have an up-to-date document directly from the Land Registry.
- 🏦 If you need a mortgage: the bank will ask you for an updated nota simple, so you will need one in any case.
🗂️ What information do I need to request it?
You only need one of the following:
- 📍 Property location: street, number, municipality...
- 🪪 Owner details: name or company name and NIF, NIE or passport number.
- 🔢 Land Registry details: registry number, section and property number.
- 🧾 CRU code of the property: you can find it on your IBI property tax receipt or through the electronic office of the Cadastre.
